Legal Agreement -- Site Access and Product Sales Terms and Conditions
The following terms and conditions apply to your purchase of products from Biodiesel Barn. By placing your order, you agree to be bound by these terms and conditions, which constitute the entire agreement between you and Biodiesel Barn regarding the products purchased.

Ordering: Your order is subject to acceptance by Biodiesel Barn and may be refused for any reason, including credit concerns, restricted product, unusual volumes, or shipping addresses. Once accepted, Biodiesel Barn may make partial shipments if some items are on backorder. By placing the order, you agree that Biodiesel Barn may do so and charge you for any items shipped.

Pricing: The price for each product purchased is reflected on your order and will remain the price regardless of any subsequent price changes by Biodiesel Barn. In addition to the quoted product price, you may pay container deposit, cleaning fee, shipping and handling charges according to your selected shipping method, plus all applicable taxes. For purposes of calculating sales tax, the location to which the product is to be shipped shall govern.

Taxes: Biodiesel Barn shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within Pennsylvania for non-exempt customers. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state.

Cancellation: Orders may not be canceled that have already been processed, charged to, paid for or shipped for any reason.

Payment: Payment in full is due prior to shipment unless customer has been approved for Biodiesel Barn credit terms or COD payment. Biodiesel Barn will accept payment via credit card, Paypal, Money Order, Cashiers Check or company check. Your credit card will be charged upon Biodiesel Barn accepting order.

Shipping: Biodiesel Barn will ship products according to your selected shipping instructions. Biodiesel Barn will attempt to ship the products within the estimated times reflected on your order but will not be liable for any failure to do so. For items on backorder, Biodiesel Barn may ship whenever the product becomes available without any notice to you. Shipping charges are non-refundable.

Title: Title to all products passes to you upon delivery of the product to the selected carrier, unless carrier is Biodiesel Barn owned truck. If carrier is Biodiesel Barn owned truck, then title of products passes to you upon delivery to your location.

Returns & Warranty: All products are sold without warranty of any kind and purchasers will, by their own tests, determine suitability of such products for their own use. NO CLAIMS FOR LOSS, DAMAGE OR LEAKAGE ALLOWED AFTER DELIVERY IS MADE IN GOOD CONDITION TO CARRIER, WAREHOUSE OR RAILROAD DEPOT.

Special Order Items: The following are considered special order items, Centrifuges, Centrifuge Parts, Centrifuge Pumps and Motors, Oil Processing Systems, Heat Exchangers, Heat Wraps, Tanks, Biodiesel Processors and also all bulk orders. Once these special orders are placed no refund, credit or return can be made.

Restocking Fee: A 30% restocking fee will be applied to all returns for refund. Shipping charges are non-refundable. No refunds for special ordered items not stocked in local Biodiesel Barn Pennsylvania warehouses. No refunds after 7 days or if item has already shipped.
Limited Delivery: Biodiesel Barn will only deliver products within the United States. Other countries need approval

Limitation of Remedies and Liability: THE REMEDIES PROVIDED HERE ARE YOUR SOLE AND EXCLUSIVE REMEDIES FOR BREACH OF THIS AGREEMENT BY BIODIESEL BARN. IN NO EVENT WILL BIODIESEL BARN BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING ACCIDENTAL, MISUSE, HANDLING, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES. IN NO EVENT WILL BIODIESEL BARN'S LIABILITY TO YOU EVER EXCEED THE TOTAL AMOUNT OF MONEY PAID BY YOU TO BIODIESEL BARN FOR THE PRODUCTS PURCHASED.

Typographical Errors: In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing. Biodiesel Barn shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Biodiesel Barn shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.

Additional terms: This agreement is governed by Pennsylvania’s law with courts as proper venue for any litigation regarding the same. Biodiesel Barn is not responsible for typographic errors. Biodiesel Barn reserves the right to change these terms or the prices charged at any time, so please check each time you purchase.
